Terms of Service

By using the Wavy Labs website and downloading our DAW software, you agree to comply with and be bound by the following terms and conditions. If you do not agree with these terms, do not use our services.

1. Eligibility

You must be at least 13 years old to create an account on the Wavy Labs website. If you are under 18, you must have the consent of a parent or legal guardian. By using the website, you represent that you meet these requirements. The DAW software itself has no age restriction.

2. Software License

The Wavy Labs DAW software is licensed under the GNU General Public License v2.0 (GPL-2.0). This means:

  • You are free to use the software for any purpose.
  • You are free to study how the software works and modify it.
  • You are free to redistribute copies of the software.
  • You are free to distribute modified versions, provided you also release the source code under GPL-2.0.

The full license text is included with the software and available at gnu.org/licenses/gpl-2.0. Wavy Labs is a fork of LMMS, which is also GPL-2.0.

3. User Accounts

Creating an account on the Wavy Labs website is optional. If you do create one, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Third-Party API Keys

Wavy Labs AI features require API keys from third-party providers (Anthropic, Groq, ElevenLabs, Freesound). These are your own keys, governed by each provider's terms of service. Wavy Labs is not responsible for charges, usage limits, or policy changes imposed by third-party providers. Your API keys are stored locally on your device and are never transmitted to Wavy Labs servers.

5. Intellectual Property

The Wavy Labs name, logo, and website design are the intellectual property of Wavy Labs. The DAW software source code is GPL-2.0 licensed as described in Section 2. Your creative output — music, audio, and other content produced using the DAW — belongs entirely to you. Wavy Labs claims no rights over your creative work.

6. Acceptable Use

You agree not to:

  • Use the website or software for any unlawful purpose.
  • Attempt to gain unauthorized access to our systems or other users' accounts.
  • Use automated systems to access the website in a manner that exceeds reasonable use.
  • Interfere with or disrupt the integrity or performance of our services.

7. No Warranty

The software is provided “as is” and “as available” without any warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Wavy Labs does not guarantee that the software will be error-free, uninterrupted, or free of harmful components. This disclaimer is consistent with the GPL-2.0 license terms.

8. Limitation of Liability

To the maximum extent permitted by law, Wavy Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use our products, including but not limited to loss of data, lost profits, or business interruption.

9. Dispute Resolution

Any disputes arising from these terms or your use of our services will first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be resolved through binding arbitration in Los Angeles County, California. You retain the right to bring claims in small claims court if eligible.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via the website. Your continued use of the website after the effective date constitutes acceptance of the updated terms. Software license terms are fixed by GPL-2.0 and cannot be changed retroactively.

11. Governing Law

These terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.
